1. Acceptance of Terms
By accessing or using NijiTube ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Age Requirement
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age. The Service may contain content rated R-18.
3. User-Generated Content
NijiTube operates as a hosting platform for user-generated content (UGC). We are not the creators or developers of user-uploaded content, and we are not in a position to pre-screen all content. Uploaders are solely responsible for the legality, accuracy, and quality of their content.
Users may upload AI-generated anime/illustration content. By uploading content, you represent that:
- The content is AI-generated and does not depict real individuals
- The content does not depict minors in any sexual or suggestive context
- You have the right to share any LoRA models, workflows, or prompts included
- The content complies with the Prohibited Content rules in Section 4 of these Terms
4. Prohibited Content
The following content is strictly prohibited:
- Deepfakes or content depicting real individuals without consent
- Content depicting minors in sexual or suggestive situations (including AI-generated and illustrated)
- Real-person photography or live-action footage
- Content that promotes violence, harassment, or illegal activities
- Malware, spam, or deceptive content
We maintain a zero-tolerance policy toward child sexual abuse material (CSAM). Any such content will be removed upon discovery.
5. Content Moderation
We may, but are not obligated to, review, monitor, or remove any content at our sole discretion, for any reason or no reason, with or without notice. We assume no liability for any content posted by users or for any failure to remove such content. Repeated violations may result in account suspension or termination.
6. Intellectual Property & License
AI-generated content uploaded to NijiTube remains the responsibility of the uploader. By sharing prompts, workflows, and generation settings, you grant other users a non-exclusive license to use those settings for their own creations.
By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote such content on the Service. This license terminates upon deletion of the content.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SERVICE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NIJITUBE OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
9. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason. Sections 7 (Disclaimer) and 8 (Limitation of Liability) shall survive termination.
10. Changes to Terms
We reserve the right to modify these Terms at any time at our sole discretion. Changes are effective upon posting to this page. The "Last updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator resides. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in the operator's place of residence.
